Terms of Service
The rules for using FoundName and for buying FoundName Pro.
1. Scope and provider
These terms apply to the use of FoundName at foundname.app, including the API and the MCP server, and to FoundName Pro. FoundName is provided by Silvio Lindstedt und Maik Gräfendorf, GbR, Pappelweg 27, 39576 Stendal, Germany, e-mail: kontakt@silvio-und-maik.de (“we”, see the legal notice). Differing terms of users do not apply.
2. Free use
Generating names and checking their availability is free and needs no account. The free version is financed by advertising; ads are only shown as described in the privacy policy and in line with your consent choices. There is no claim to a particular scope of functions for the free version.
You may create a free user account (e-mail and password, or sign-in with Google or GitHub) to keep projects and favorites across devices. Keep your login details to yourself and tell us if you suspect misuse. You can delete the account yourself at any time. A Pro license bought or activated while signed in is bound to the account and then works only while you are signed in to it; you can release it in the account settings, and after a deletion the key itself keeps working.
3. FoundName Pro
FoundName Pro removes the ads, raises the limits for projects and presets and unlocks access to the API and the MCP server. Pro is sold as a one-time purchase, not a subscription:
- “Year”: a fixed price for 12 months of Pro,
- “Flex”: an amount of your choice between 2 € and 100 € for 3 months of Pro.
The term starts with the purchase. Pro does not renew automatically and ends at the end of the term without notice; you can buy it again at any time. The prices shown at checkout apply. Pro is delivered immediately: after payment you receive a license key on screen and by e-mail.
The license key is personal. You may use it on any number of your own devices, but not pass it on, share it with others, publish it or resell it. If a key is misused, we may block it.
4. Payment via Paddle
Purchases are handled by our reseller Paddle.com Market Limited (30 Old Bailey, London EC4M 7AU, United Kingdom) as merchant of record. Your purchase contract is concluded with Paddle; Paddle processes the payment, issues the invoice and handles VAT, refunds and chargebacks. For this, Paddle’s Buyer Terms apply. 5. Results, availability, no legal advice
FoundName checks names against public sources (such as the App Store, Google Play and domain registries) at the moment of the query. The results are an automated snapshot. We do not guarantee that a name shown as free is actually available, can be registered or remains free, and we do not check trademark rights or other third-party rights. A result is no legal advice and does not replace a trademark search or legal counsel before you use a name.
We aim to keep FoundName available at all times, but do not guarantee uninterrupted availability. External sources can be unreachable or answer late; maintenance can cause short interruptions.
6. Fair use and rate limits
To keep the service usable for everyone and to protect the queried sources, requests are rate-limited. You may not circumvent limits, overload the service, query it automatically outside the API or use it for unlawful purposes. We may throttle or block requests or keys that violate this.
7. API and MCP
The API and the MCP server are part of Pro and are used with your license key. Keep the key secret and store it only in your own tools. The rate limits per key and the interface described on the developer page apply; we may develop the interface further. Access may not be passed on to third parties or resold.
8. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slightly negligent breaches of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely), our liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded. These limits also apply in favour of our vicarious agents.
9. Changes to these terms
We may change these terms for the future, for example when features or legal requirements change. For a Pro term already purchased, the terms valid at the time of purchase apply until it ends.
10. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you have your habitual residence. Should individual provisions be invalid, the remaining provisions remain effective.
